Terms of Service

Welcome to Vibyng. The platform is a digital ecosystem designed to connect emerging artists and fans, turning interaction into direct economic support. By accessing or using our services, the user agrees to comply with these Terms and Conditions.
1. Scope of the Service
Vibyng provides tools for creating professional artist profiles, publishing content, managing events and using a "Reward Economy" system based on Vibyng Points.
The platform acts as a technical intermediary and does not provide proprietary streaming services. Content may be uploaded directly by users or integrated through third-party links or embedding, within the limits allowed by the platform and applicable law.
2. Registration and Requirements
- Minimum age: use of the platform is reserved for users who are at least 14 years old.
- Account: the user is responsible for keeping their credentials confidential and for all activities carried out through their account.
- User types: the platform distinguishes between "Artists" (creators), "Fans/Supporters" and "B2B Partners".
- Information provided: the user agrees to provide truthful, updated and complete information during registration and while using the platform.
3. Monetization and Transactions
- Economic support: fans may support artists through one-time donations or monthly subscriptions of €4.99, unless different features, amounts or formulas are introduced in the future.
- Commissions (Take Rate): Vibyng retains a 30% commission on transactions to cover platform management, development and maintenance costs.
- Payment management: all financial transactions are handled through secure payment service providers, such as Stripe. Vibyng does not directly store credit card data.
- Artist obligations: the artist is responsible for any tax, social security or reporting obligations arising from amounts received through the platform, unless otherwise provided by law or by the payment services used.
4. Reward Economy (Vibyng Points)
- Nature of points: Vibyng Points are an internal loyalty system with no external legal or monetary value. They cannot be converted into fiat currency, do not constitute electronic money, cryptocurrency, a financial instrument or an investment product, and cannot be transferred outside the platform.
- Earning points: points may be earned through social interactions, comments, shares, event participation, economic support to artists or other activities provided by the platform.
- Use: Vibyng Points may be used to unlock badges, reputation levels, early-access content or benefits with affiliated partners.
- Changes to the system: Vibyng reserves the right to modify, suspend or limit the Vibyng Points system in case of abuse, fraud, technical malfunction or platform update requirements.
5. Intellectual Property, Music Rights and Uploaded Content
- User rights: the artist retains full ownership of the content uploaded to Vibyng, including, by way of example, songs, lyrics, audio recordings, images, videos, artwork, photographs and promotional materials.
- Rights declaration: by uploading a song or any other content to Vibyng, the user represents and warrants that they are the author, the rights holder or have obtained all necessary authorizations to publish, reproduce, communicate to the public, distribute and make such content available through the platform.
- Music content: this declaration includes, by way of example, musical composition, lyrics, audio recording, vocals, beats, instrumental tracks, samples, remixes, covers, arrangements, artwork and any other element protected by copyright, related rights, image rights or other third-party rights.
- License to Vibyng: by uploading content to the platform, the user grants Vibyng a limited, non-exclusive, royalty-free, worldwide license, revocable within the technical limits required by the service, to host, store, display, reproduce, distribute and make such content available solely for the purpose of providing the service and enabling the operation of the platform.
- Third-party content: for content integrated through embedding or third-party links, such as Spotify, YouTube or other external services, the user must comply with the terms of service of the respective platforms and applicable laws.
6. Copyright Infringement Prohibition and User Responsibility
Users are prohibited from uploading, publishing or sharing content that infringes copyright, related rights, trademarks, image rights, moral rights, personality rights or other third-party rights.
The user is solely responsible for the content uploaded, published or shared through their account and agrees not to use Vibyng to publish songs, beats, samples, remixes, covers, recordings, images, videos or materials for which they do not hold the necessary rights or authorizations.
In case of false declarations, unauthorized uploads or infringement of third-party rights, Vibyng may remove the content, limit its visibility, suspend or terminate the user's account and take any further measure reasonably necessary to protect the platform, other users and rights holders.
The user also agrees to indemnify Vibyng, to the extent permitted by law, from claims, requests, damages, costs or liabilities arising from uploaded content or from any breach of these Terms.
7. Copyright Infringement Reports and Takedown Procedure
Rights holders or authorized representatives may report content available on Vibyng that they believe infringes their rights by writing to support@vibyng.com.
The report should include, where possible:
- identification of the disputed content;
- link, username, song title or other useful elements to identify the content;
- description of the right allegedly infringed;
- contact details of the reporting party;
- statement confirming ownership of the right or authorization to submit the report;
- any useful documentation supporting the request.
Vibyng will review received reports and, where necessary or appropriate, may remove or disable access to the disputed content, request clarification from the user who uploaded it and take measures against repeat infringers or accounts responsible for serious violations.
Vibyng reserves the right to restore removed content if the report is found to be unfounded, incomplete, abusive or insufficiently documented.
8. User Conduct and Moderation
It is forbidden to publish illegal, offensive, discriminatory, defamatory, violent, pornographic, fraudulent, misleading or otherwise unlawful content, or content that breaches these Terms or the purpose of the platform.
It is also forbidden to abuse the Reward Economy system, create artificial interactions, use bots, automated tools, fake accounts, spam practices or any behavior aimed at altering the proper functioning of the platform.
Vibyng reserves the right to remove content, limit features, suspend or terminate accounts that violate these guidelines or may cause damage to the platform, users, artists, partners or third parties.
9. Limitation of Liability
Vibyng is not responsible for the quality of artistic performances, for the failure to deliver benefits promised by artists, for disputes between artists and fans or for service interruptions caused by force majeure, technical maintenance, updates, third-party provider malfunctions or events not directly controllable by Vibyng.
Vibyng does not perform systematic prior control over all content uploaded by users. However, it reserves the right to act on content that is reported, manifestly unlawful or contrary to these Terms.
10. Beta Service
Vibyng is currently in Beta. The service may undergo changes, temporary interruptions, limitations, technical errors or functionality variations without prior notice.
Use during this phase is experimental. The owner is not liable for service issues connected to the experimental nature of the platform, except within the mandatory limits provided by law.
11. Changes to the Terms
Vibyng reserves the right to update or modify these Terms for technical, legal, commercial or organizational reasons. Users will be informed of relevant changes through the platform, the website or other reasonably appropriate channels.
Continued use of the platform after the Terms have been updated constitutes acceptance of the changes, unless otherwise provided by law.
12. Applicable Law and Jurisdiction
These Terms are governed by Italian law.
For any dispute arising from the use of the platform, the parties recognize the exclusive jurisdiction of the Court of Catanzaro, unless otherwise provided by mandatory consumer protection laws or other applicable mandatory rules.
